1. Trader and scope
Costa Guest+ is supplied by HET KRUIDENNIERTJE, S.A., CIF/NIF A29757945, Avda. Carlota Alessandri 43, 29620 Torremolinos, Málaga, España. Mercantile Registry: Registro Mercantil de Málaga, Tomo 1761, Libro 674, Folio 90, Sección 8, Hoja MA 22997. Costa Guest is its service/trade name. Support: support@costaguest.com. These terms apply when a natural person acting outside a trade or profession purchases a paid Costa Guest+ plan. They supplement the general Terms of Use and mandatory consumer law prevails where applicable.
2. Service and plan
Costa Guest+ is a digital membership that may include increased Concierge usage, saved places, member deals, premium editorial/planning features, itineraries and other benefits shown for the selected plan. The exact active entitlements are those displayed immediately before purchase and in the account after activation.
Third-party venues, offers, transport, activities and booking providers remain subject to their own availability and terms. A Costa Guest+ subscription does not guarantee third-party inventory, prices or fulfilment.
3. Price, taxes and recurring billing
Before purchase, checkout must show the total price payable, applicable taxes, billing period, whether the subscription renews automatically and the accepted payment method. No hidden mandatory charge may be added after the user commits to pay.
Where a weekly, monthly or annual plan is sold as recurring, it renews for the stated billing period until cancelled. Stripe may process payment on our behalf. Costa Guest does not intend to store full card data.
4. Order flow and confirmation
Immediately before ordering, the user must be shown the essential service characteristics, total price, subscription duration/renewal, cancellation information and withdrawal information. The final purchase button must use unambiguous wording that makes the payment obligation clear.
The applicable terms must be available before purchase. After the contract is concluded, the user will receive confirmation on a durable medium, normally email, containing or linking to the contractual information that must legally be retained.
5. Activation, duration and cancellation
Unless checkout states otherwise, paid access is intended to begin after successful payment. The subscription remains active for the paid billing period and, for recurring plans, renews until cancelled.
Users must be able to cancel without an artificial obstacle. Unless a more favourable rule is shown at checkout, cancellation stops future renewals and access continues until the end of the already-paid billing period. Cancellation is separate from the statutory withdrawal right described below.
6. Statutory withdrawal right
Consumers generally have 14 calendar days from conclusion of a distance service contract to withdraw without giving a reason, subject to the statutory exceptions. Costa Guest will not rely on any loss or limitation of that right unless all legally required conditions and express acknowledgements have been satisfied.
If the consumer expressly asks for the service to begin during the withdrawal period, checkout must capture that request where legally required. Any amount that may lawfully be due for service already supplied during the withdrawal period will be handled only in accordance with mandatory consumer law.
To exercise withdrawal, send an unequivocal statement to billing@costaguest.com or support@costaguest.com. A model statement is: “I hereby withdraw from my Costa Guest+ contract. Name: __. Account email: __. Order/contract date: __. Date: __.” No special wording is required if the decision to withdraw is clear.
7. Refunds, failed payments and price changes
Statutory refunds, including valid withdrawal refunds, will be made using the legally required method and timing. A failed renewal may suspend paid entitlements after reasonable notice where appropriate.
A price increase for a future renewal will not be silently applied where prior notice or renewed agreement is legally required. Users will be told of material changes in advance and given the legally required cancellation options.
8. Digital-service conformity and availability
Mandatory legal rights concerning conformity of digital services remain unaffected. We may make reasonable updates for security, compatibility, legal compliance and product improvement, without removing mandatory rights.
Temporary interruption may occur for maintenance, incidents or dependencies. Nothing in these terms excludes liability or remedies that cannot lawfully be excluded.
9. Complaints and support
Questions, cancellation requests or complaints can be sent to support@costaguest.com; billing matters to billing@costaguest.com; written correspondence may also be sent to Avda. Carlota Alessandri 43, 29620 Torremolinos, Málaga, España. We will identify any applicable consumer ADR mechanism if and when Costa Guest adheres to one or is legally required to participate.
10. Law and jurisdiction
Spanish law applies without depriving consumers of mandatory protection granted by the law that is applicable to them. Mandatory consumer-jurisdiction rules remain unaffected.
